Joe Paterno wants football recruits to consider Penn State on its merits, not on whether the Hall of Fame coach will be around for the length of their stay. Speaking before an Alumni Club function in suburban Philadelphia on Saturday, the 81-year-old Paterno cited Penn State's strong academics and football history as reasons recruits should think about going to school in Happy Valley.

Timmons was charged with disorderly conduct and defiant trespass after an Oct. 7 fight that involved three other Penn State players. One man was injured in the campus fight.

The decision comes after the state Superior Court ruled earlier in the day that jurors could hear testimony about the alleged victim's involvement in a separate sexual assault case in 2003.
